Zoning Board of Appeals -- Meeting Minutes -- January 5, 2012

A duly posted monthly meeting of the Shelburne Zoning Board of Appeals was held at in the main Meeting Room at Town Hall, 51 Bridge Street, in Shelburne on January 5, 2012.

Members Present: Joseph Palmeri, Lowell Laporte, John Taylor, Theodore Merrill, William Sweeney
Members Absent: Catherine Smith

The meeting was called to order by Chairman Joe Palmeri at 7:05pm.

The Board spent some time reviewing and approving minutes:

  • Taylor moved to approve the hearing minutes of the 11/3/2011 Hearing for Brandin, Sweeney seconded, and the minutes were approved with minor corrections. Palmeri abstained.
  • Laporte moved to approve the meeting minutes of the 11/10/2011 meeting, Taylor seconded, and the minutes were approved with minor corrections.
  • Sweeney moved to approve the hearing minutes of the 11/10/2011 Hearing for Brandin, Taylor seconded, and the minutes were approved with minor corrections.
  • Sweeney moved to approve the hearing minutes of the 11/17/2011 Hearing for Mount Massaemet Wind Farm, Merrill seconded, and the minutes were approved with minor corrections.
  • Sweeney moved to approve the meeting minutes of the 11/17/2011 meeting, Taylor seconded, and the minutes were approved with minor corrections.
  • Sweeney moved to approve the meeting minutes of the 12/8/2011 meeting, Laporte seconded, and the minutes were approved with minor corrections.

Merrill wanted it noted that the minutes, particularly of the Wind Farm hearing, were "awesomely good", and recognized our assistant, Faye Whitney, who unfortunately was not present to receive his commendation due to a family event.

The Board reviewed the ongoing Town discussion about industrial windmills, Planning Board inquiries, articles in the press, and the Chair reported on conversations he has had with other Town boards and committee members on the topic.

Taylor resurrected a list of potential bylaw clarifications, which the Board discussed in October 2010; some of which had originally been submitted to the Town by the Attorney General's office, and others from earlier discussions on inns/hotels/motels/etc. The Board will review individually.

It was noted the Planning Board has not responded to this Board's bylaw change recommendation concerning the notification process in the Special Permitting (Section 6) of the zoning bylaw. Palmeri said he would follow-up with the Planning Board as to their progress.

The Chair reported that John Pollard expressed interested in rejoining the ZBA following the recent Wind Farm hearing. The balance of the mail was reviewed consisting of newsletters and related trainings and regional hearings.

A motion was made to close the meeting; it was seconded, and so voted at 8:35pm.
