Zoning Board of Appeals -- Meeting Minutes -- May 3, 2012

A duly posted meeting of the Shelburne Zoning Board of Appeals was held in the Meeting Room at Memorial Hall, Shelburne, on May 3, 2012.

Members Present: William Sweeney, Theodore Merrill, Lowell Laporte, Joseph Palmeri, John Taylor
Members Absent: Catherine Smith

Chairman Joseph Palmeri called the meeting to order at 7:13 p.m.

The Board discussed the outcome of Town Meeting votes on May 1 concerning a citizens petition to restrict wind power facilities, and the Planning Board moratorium article on wind power facilities, which were both approved by voters. The Chair reported on Town Counselís opinion concerning the votesí impact on the process to respond to the application of Frederick D Field, and the additional impact of the applicant filling a preliminary subdivision plan with the Planning Board in the days prior to Town Meeting. Merrill is interested in finding out the Planning Boardís timeline and process for constructing a zoning bylaw concerning wind power.

A motion was made by Mr. Sweeney, seconded by Mr. Merrill, to approve the meeting minutes of April 5, 2012 with corrections noted.

The Clerk reported that he filled a records request from Larry Gould asking for copies of the last two Board meeting minutes.

The Board reviewed and filed a letter from Mr. Stafursky of Conway concerning the first application of Field/Mt Massaement Windfarm that was received after that public hearing was closed.

The Board set a time for the Public Hearing for the application of Frederick D Field representing Mt Massaemet Windfarm Inc.for a Special Permit to construct a wind power facility on Mt. Massaement. The application was received on April 2nd. The Board set May 24, 2012 at 8PM for the hearing. It will be held at Buckland Shelburne School if the space is available on that night as the Memorial Hall is in use for a concert. If that date canít work for the school the Board agreed to schedule for May 23rd. The Clerk will post. A meeting will precede the hearing at 7PM.

The Board will next meet for a hearing on May 10th for the two applications relative to Greenfield Savings Bank. A meeting will precede the hearings at 7PM.

Merrill suggested the Board have more clear criteria about what is needed for an application to be considered a ìcomplete applicationî. The Board briefly discussed options and past practice for dealing with applications which require additional information.

Merrill moved to close the meeting at 8:30pm, Sweeney seconded and it was so voted unanimously.
