Zoning Board of Appeals -- Meeting Minutes -- December 8, 2011

A duly posted special meeting of the Shelburne Zoning Board of Appeals was held at the Selectmen's Meeting Room at Town Hall, 51 Bridge Street, Shelburne, on December 8, 2011.

Members Present: John Taylor, Lowell Laporte, William Sweeney, Joseph Palmeri
Members Absent: Theodore Merrill, Catherine Smith

Clerk Joseph Palmeri called the meeting to order at 7:10pm, and immediately recessed the meeting in order to continue the Public Hearing on the Special Permit application by Jeremy Coleman.

The meeting was called back to order at 7:43pm.

The Board started deliberation on the Coleman application to convert the property at 45 Water Street to a 4-unit Multi-Family Dwelling. The Board reviewed the information collected at the Public Hearing, reviewed Special Permitting requirements, and discussed the proposal. Discussion focused on parking and community impact.

Laporte moved that the Board approve the application and, based on the Board's findings and data shown in plans by J Coleman & Company (Plan LS1 dated 12/6/11, and Plans A1, A2, A4 dated 11/22/11), the Zoning Board of Appeals GRANT a Special Permit, pursuant to Sections 4.3 of the Town of Shelburne Zoning Bylaws, to Jeremy Coleman to convert the former Mohawk Manor Rest Home, at 45 Water St, Franklin County Registry of Deeds Book 5660 Page 185, Shelburne MA 01370, into a 4-unit multi-family dwelling, subject to the following condition:

The applicant will provide and maintain screening on the south and east lot lines of the parking lot area as described in Section 11.2.3 of the Bylaw.

Sweeney seconded and after further discussion the Board voted in favor of the motion to GRANT the Special Permit.

Voting in favor of Special Permit: Taylor, Sweeney, Laporte, Palmeri
Voting in opposition to Special Permit: None
Abstentions: None

The Board checked mail, reviewed past and future meetings, and then Laporte moved to close the meeting at 8:56pm, Sweeney seconded, and it was so voted unanimously.
