Zoning Board of Appeals — Meeting Minutes — July 29, 2010

A duly posted meeting of the Shelburne Zoning Board of Appeals was held at the Selectmen's Meeting Room at Town Hall, 51 Bridge Street, Shelburne, on July 29, 2010.

Members Present: John Taylor, William Sweeney, Ted Merrill, Catherine Smith, Lowell Laporte
Administrative Assistant: Faye Whitney
Members Absent: Joe Palmeri, John Pollard

Chairman pro tem William Sweeney called the meeting to order at 7:05 p.m.

At 7:15 p.m. Ms. Smith, seconded by Mr. Laporte, moved that the regular meeting of the Board be recessed for the purpose of entering into a public hearing.
Voting in favor: Mr. Taylor, Mr. Sweeney, Mr. Merrill, Ms. Smith, Mr. Laporte
Opposed: None
Abstaining: None

At 8 p.m. the regular meeting resumed, following the hearing.

A motion was made by Mr. Laporte, seconded by Mr. Merrill, that in lieu of a variance, the Board votes to grant the appeal of Mark and Ellen Kaufmann, to permit the replacement of a pre-existing, non-conforming structure, a 18'x20' garage, on the same footprint and in accordance with plans submitted by applicant, at 68 Main Street, Shelburne, based on the Board's determination that the applicant is entitled to replace the garage under Shelburne Zoning Bylaws Sections 10.1.3 and 10.1.4, provided that the new building is equal in appearance and character to the original structure, and further, that a variance is not required.

Voting in favor: Mr. Taylor, Mr. Sweeney, Mr. Merrill, Ms. Smith, Mr. Laporte

The decision from the Kaufmann hearing will be filed with the Town Clerk and draft copies sent to the Building Inspector and the applicants. The final certified copy of the finding will be sent to the Kaufmanns, following the appeal period.

The Board discussed an upcoming hearing and which members would be available.

A letter from the Building Inspector was received, which denied a resident permission to build a shed.

A motion was made by Mr. Laporte, seconded by Mr. Merrill, to approve the meeting minutes of July 1.

Opposed: None
Abstaining: Ms. Smith, Mr. Taylor

A site visit for the proposed Shelburne Falls Inn was scheduled for August 10, at 5 p.m. It was noted that no site plans or architectural plans have been made available as of this time.

At 9:04 p.m. Mr. Merrill moved that the meeting be adjourned. This was seconded by Mr. Laporte. The vote was unanimously in favor.
