    Zoning Board of Appeals — Meeting Minutes — October 8, 2009

    A duly posted meeting of the Shelburne Zoning Board of Appeals was held at the Selectmen's Meeting Room at Town Hall, 51 Bridge Street, Shelburne, on October 8, 2009.

    Members Present: Joseph Palmeri, John Pollard, William Sweeney, Lowell Laporte, John Taylor

    Members Absent: Theodore Merrill, Catherine Smith
    Others present: Carlos Centore, Maria Montrose, Sandy Carter, Carl Gehring, Doug Sheadel, Doug Drost, Steve Weatherbee

    Chairman Joe Palmeri called the meeting to order at 7:14 p.m. and immediately recessed for public hearings relative to the applications of Verizon Wireless at Cooper Lane and Old Albany Road.

    The Board deliberated the request from RCC Atlantic Inc. d/b/a Verizon Wireless, for the purpose of architectural and engineering plan review and/or other zoning relief as required in accordance with Shelburne Zoning By-Laws Section 16.0 for the project at 128G Old Albany Road.

    Mr. Palmeri said the plans all seemed to be in order.

    Following discussion Mr. Taylor summarized lthe following conditions:
    1) The applicant shall complete any structural upgrades and/or improvements to the supporting tower as outlined in the submitted Structural Analysis dated 2/12/2009, and as otherwise required by the Building Inspector; and
    2) The applicant shall comply with all applicable access agreements for ingress and egress to the subject premises; and
    3) The applicant shall limit the days of construction activities to Mondays through Fridays for the duration of the improvement project, and not commerce work before 7 a.m.

    The following motion was made by Mr. Taylor and seconded by Mr. Sweeney:

    The Zoning Board of Appeals approves the Architectural & Engineering Plans dated 08/20/2009 and 10/7/2009, submitted by RCC Atlantic Inc. d/b/a Verizon Wireless, based on the information provided at the public hearing, the applicant's written submission dated 08/20/2009, and the findings of the Board, for the installation of antennae, equipment shelter, and ancillary equipment by Verizon Wireless, at the SBA Properties tower located at 128G Old Albany Road, as permitted under Section 16.4.A.1 of the Zoning Bylaws, subject to the following three (3) conditions:

    1) The applicant shall complete any structural upgrades and/or improvements to the supporting tower as outlined in the submitted Structural Analysis dated 2/12/2009, and as otherwise required by the Building Inspector; and

    2) The applicant shall comply with all applicable access agreements for ingress and egress to the subject premises; and
    3) The applicant shall limit the days of construction activities to Mondays through Fridays for the duration of the improvement project, and not commerce work before 7 a.m.

    Discussion took place on whether to begin deliberations on the Verizon's Cooper Lane project, as the time was now 10:20 p.m. Mr. Palmeri felt input was needed from the Select Board, DPW and Mr. Cohn regarding the issue of the access road and the washout, which affect Cooper Lane.

    After discussion it was decided that the next meeting would be held on Tuesday, November 10.

    At 11:20 p.m. Mr. Laporte moved that the meeting be adjourned. This was seconded by Mr. Pollard. The vote in favor was unanimous.
