Call to Order: John called the meeting to order at 3:30 p.m. Other members present: Joe Judd. Bob Manners was unable to attend.

Media Present: Cameron Graves, Shelburne Falls Independent.

Appointments:
Public Disclosure: Before opening the hearing, John disclosed that Foxbard Farm will supply beef to Daniel and Michelle's restaurant. John indicated that his business relationship with the Mojallali's will have no effect on his ability to perform as a member of the Select Board.

3:30 p.m. Liquor License Hearing for Daniel Mojallali, "The Bakers Oven, Inc." located at 24 Bridge Street (Daniel and Michelle Mojallali were in attendance) - John Payne read the hearing notice aloud. The Baker's Oven, Inc. is seeking a full alcoholic beverages license. They have pledged their license and their inventory in order to secure funding for the business. John turned the hearing over to the Mojallali's. Daniel indicated that he and his wife have been in the restaurant business for over 15 years. They reside in Colrain. Two years ago, he built a mobile wood fired oven and began making pizzas and breads selling them at various local festivals. During that time, he has been approached by many individuals encouraging him to open a restaurant. When Caf? Martin closed, he and his wife agreed that the location would be perfect. They intend to open March 1st. Business hours are Wednesday through Sunday from 10:00 a.m. until 9:00 p.m. They will feature homemade soups, freshly baked breads, salads, pizza and local cheeses. Similarly to Cafe Martin, the alcohol they offer; will complement the food. Daniel indicated that while waiting for the Alcoholic Beverages Control Commission's approval of the license, they hope that the Board would consider granting a "Carry in Beer & Wine" license. They have acquired the necessary liquor liability insurance and their servers will be trained. John spoke at length about the responsibilities of having a liquor license and the Board's expectations if granted. The hearing was closed. Joe presented a motion to approve the application for an all alcoholic beverages license and grant a temporary "Carry in Beer & Wine" license until the Mojallali's receive approval from the ABCC. John seconded the motion. Motion carried.

OTHER BUSINESS:
FY'13 Budget Review - John and Joe reviewed the omnibus budgeted and requested that the following departments be scheduled to present their budget before the Board and Finance Committee: Police, Highway, and Planning Board. The Board agreed to schedule an additional meeting on March 20, 2012 at 3:00 p.m. in order to continue budget related work.

Kopelman and Paige, P.C. RE: Review of Draft Cable Television Renewal License - at the request of Buckland and Shelburne Select Boards, Kopelman and Paige reviewed the contract document. Their review resulted in three recommendations relative to sections: 2.3 (d); 10.4 (h); and 12.2 (a). Joe presented a motion to accept Kopelman's three recommendations; John seconded the motion. Motion carried. Once Buckland's Select Board had had an opportunity to review, a letter will be sent to Comcast seeking amendments to the contract.

ADJOURMENT: Joe presented a motion to adjourn the meeting at 4:10 p.m. John seconded the motion. Motion carried.
